These Terms of Use (“Terms”) govern your use of dimearcade. By using the site, you agree to these Terms.

1. The service

dimearcade is a free-to-browse online portal for licensed HTML5 browser games, primarily embedded from our partner Playgama (and similar licensed partners).

We do not offer, host, or distribute:

ROMs
Emulators
Unauthorized copies of console, arcade, or PC games
Any claim that we own third-party game intellectual property we have not licensed

Game titles, characters, trademarks, and related IP belong to their respective owners or licensors. dimearcade provides a discovery and play shell; partner embeds supply the playable content under their licenses.

2. Eligibility

The site is for a general audience and is not directed at children under 13. Do not use dimearcade if you are under 13. If you are under the age of digital consent in your country, use the site only with a parent or guardian’s permission where required.

3. Acceptable use

You agree not to:

Attempt to reverse-engineer, scrape at abusive scale, or disrupt the site or embeds
Circumvent security, payment, or access controls
Use the site for illegal activity, harassment, or malware distribution
Misrepresent that dimearcade owns partner or third-party game IP
Interfere with ads or content served inside partner game embeds in ways that violate partner terms

We may suspend or block access if we reasonably believe you breached these Terms.

4. Games, ads, and partners

Playable games load from licensed partner embeds (e.g. Playgama). Availability, quality, and content of a given title are controlled by the partner.
Advertising inside games is provided by the partner (or the partner’s ad network), not by dimearcade. We are not responsible for ad content, targeting, or partner ad policies beyond choosing to embed their player.
Partner terms and privacy policies also apply when you play an embedded game.

5. Optional tips and VIP

dimearcade may offer optional tips or VIP features fulfilled through Stripe (or another stated payment provider).

Those features are optional and not required to browse or play free games on the portal.
Prices and benefits will be shown in the product UI at purchase time.
We do not invent or hard-code live payment URLs in these Terms; checkout links are configured in the live site only.
Refunds, if any, follow the payment provider’s tools and any policy we state at purchase time / in support replies.

6. Favorites and local features

Features such as favorites may be stored in your browser (local storage). Clearing browser data can remove them. We do not promise cross-device sync in the current version.

7. Intellectual property

The dimearcade name, logo, layout, and original site copy belong to dimearcade (or are used under license).
Embedded games and related assets remain the property of their owners/licensors.
You may not copy the site shell or scrape game catalogs for competing commercial use without permission.

8. Disclaimers

THE SITE AND EMBEDS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Games may go offline, change, or contain errors outside our control.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF DIMEARCADE OR PARTNER EMBEDS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR TIPS/VIP IN THE 12 MONTHS BEFORE THE CLAIM OR (B) CHF 50 (or local equivalent).

Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the maximum allowed by law.

10. Indemnity

You will defend and hold us harmless from claims arising out of your misuse of the site or your breach of these Terms, to the extent permitted by law.

11. Changes

We may update these Terms. The “Last updated” date will change when we do. Continued use after changes means you accept the new Terms.

12. Governing law

These Terms are governed by the laws of Switzerland, without regard to conflict-of-law rules. Courts of Zurich, Switzerland have non-exclusive jurisdiction, unless mandatory consumer rules in your country say otherwise.

If you need a different governing law (for example, after registering a company elsewhere), tell us and we will revise this section.
